Nope, he was clearly guilty. Although busting a bloke who has broken bones and a burnt out bike for three points and a £60 fine on top is clearly kicking a man when he is down. Every time you fuck up, however slightly, and even if you don't fall off or crash into anything, that's the definition of 'riding without due care'. Because if you were riding WITh due care, of course you wouldn't have made the mistake, would you. So mistake = without due care.

Falling off all on your own without any help is overwhelming evidence of a mistake, and evidence of a mistake is, as discussed above, evidence that you are guilty of 'Riding Without Due Care'. Collect 3 points & a £60 fine, do not pass go.
